Appellants, Bank of America, N.A. and Bank of America Corporation (hereinafter collectively referred to as Bank of America or the Bank), appeal from an order of the trial court denying the Bank’s motion to compel arbitration under the Federal Arbitration Act (FAA) of the District of Columbia’s claims for damages for losses incurred as the result of a protracted fraudulent scheme perpetrated by the District’s employees and allegedly facilitated by Bank of America.
