Here we have a case involving the legality of a foreclosure of a residential mortgage after the homeowners had filed an application for a loan modification. Plaintiffs Vinny and Stephen Brickett (collectively, “the Bricketts”) brought suit in Massachusetts state court against HSBC Bank USA, N.A. (“HSBC”) for a violation of (1) the mortgagee’s obligation of good faith and reasonable diligence and (2)' the Massachusetts Consumer Protection Act, M.G.L. c. 93A, § 9.
