Plaintiff seeks to recover the amount due on two policies of insurance in which she was named as principal beneficiary, issued to her nephew, Henry O. Lott, a member of the military service in the amount of $5,000 each, under the provisions of the National Service Life Insurance Act of 1940. 38 U.S.C.A. § 801 et seq. The defendant thought that plaintiff did not stand “in loco parentis” to the insured, and was therefore not an authorized beneficiary under the Act, and moved that Janie Elizabeth Bond, sister and contingent beneficiary, be made a party defendant, which…
