VAN VALKENBURGH, District Judge.

This is a suit to recover on a policy of war risk insurance. The plaintiff is the beneficiary naped by the deceased soldier, Robert R. Parks. The case was tried in part upon an agreed statement of facts, which, in so far as is material to this discussion, contains the following recitals:
