I. The plaintiff appeals from the order of the court dismissing the petition as to defendants Allyn and Dunning, and defendant C. M. Hickman appeals from the judgment against him.
1 We first notice the appeal as to Allyn and Dunning. The following are the findings of the district court as to facts and the law: “(1) That on and prior to December 1, 1894, the defendants M.
