For a statement of the case we will use the wording of appellant. “This suit was instituted by Attorney Will Crow, appellee, against the appellant on February 4, 1957, wherein the appellee sued the appellant for $5,000,00 as attorneys fees for services rendered for the estate of D. F. Urschel, deceased father of appellant. The original petition was signed by Will Crow, Per Se. Thereafter, on April 26, 1957, appellant filed his original answer containing special exceptions, general denial and a special plea of payment. On May 22, 1957, appellee filed an amended petition…
