MEMORANDUM OPINION AND ORDER

LEON, District Judge.

Before the Court is the defendants’ motion to dismiss for lack of subject matter jurisdiction, and standing. The plaintiffs in this case seek to challenge, under the Administrative Procedure Act (“APA”), 5 U.S.C. § 701, et seq., and section 307 of the Tariff Act of 1930, 19 U.S.C. § 1307 (“Section 307”), the actions of the Commissioner of Customs and Border Protection with regard to cocoa imported to the United States from Cote d’Ivoire.
