Appeal from an order of the Family Court of Cortland County (Avery, Jr., J.), entered April 23, 2001, which granted petitioner’s application, in a proceeding pursuant to Social Services Law § 384-b, to adjudicate respondent’s child to be the child of a mentally retarded parent, and terminated respondent’s parental rights.

Respondent is the biological mother of William BB., who has been in the care of foster parents since his birth in 1998, initially as a result of respondent’s consent and later as a result of her homelessness, alleged mental retardation and neglect. In 2000, petitioner…
