The appellee, Sam Kruger; instituted this suit in the district court of Wichita county against appellant, Joe Col-onna, upon the following account:

The plaintiff alleged that the jewelry specified in the above account had been purchased from him by the defendant acting through his wife as his duly authorized agent to make such purchases. In a supplemental petition he further alleged that Mrs. Colonna, as the wife of the defendant, was authorized to make such purchases and the same were necessary for her personal adornment, and that there was an implied promise on the part of defendant to pay…
