William Ryan and Anna Ryan, copartners, doing business as Ryan and Co., hereinafter called plaintiffs, brought suit in the superior court of Gila county against Frank H. Thomas, treasurer of Gila county, Arizona, hereinafter called defendant, seeking a declaratory judgment under the provisions of article 12, chapter 93, Revised Code 1928.
