This is an appeal from an order of the Court of Common Pleas of Madison county, Ohio, rendered in the above-entitled case, in an action by the treasurer of Madison county for the foreclosure of a tax lien on certain real estate, amounting to $4,420.02.

All named parties were served either personally or by publication, and all were in default for answer or demurrer. The court thereupon found in favor of the plaintiff, as treasurer, and held that there was due from David A. Fitzgerald, Sr., life tenant, and Madeline Fitzgerald, Evelyn Fitzgerald and David A.
