Appeal by the defendant, as limited by his brief, from so much of an order of the Supreme Court, Kings County (Walsh, J.), dated October 18, 2011, as, after a hearing, designated him a level three sex offender pursuant to Correction Law article 6-C.
Ordered that the order is affirmed insofar as appealed from, without costs or disbursements.
Since it was undisputed that the defendant had previously been convicted of a felony sex crime, the defendant was presumptively a level three sex offender pursuant to an automatic override, irrespective of the points scored on the risk assessment instrument…
