Plaintiff, Matteo Incandela, appeals from an order of the circuit court of Du Page County dismissing with prejudice his second amended complaint against defendant and third-party plaintiff, Leonard Giannini. On February 4, 1991, plaintiff brought his cause of action against defendant for allegedly violating the statutory provisions of the Structural Work Act (740 ILCS 150/1 et seq. (West 1992)).
