This is an action filed by plaintiff John E. Hall against the defendant wherein he asked $10,000 in damages for personal injuries alleged to have been sustained when defendant’s car struck plaintiff while it was in an automatic ear wash establishment. A trial resulted in a verdict for the defendant. The trial court granted a new trial on the ground that instruction No. 3 given by the court at defendant’s request was erroneous. From the order, the defendant appealed.
