INTRODUCTION

In this case, we are asked to determine whether an oral modification of a preexisting joint bank account with rights of survivorship was valid.

BACKGROUND

On January 18, 1984, Neil and Winona Linehan, husband and wife, opened a bank account with the First National Bank of Gordon, Nebraska. The account signature card, signed by Neil and Winona when they opened the account, indicates that this was a joint account with rights of survivorship.
