Plaintiffs in error filed this suit in the district court of Bexar county against Mrs. Agnes Boedker and the First State Bank of Corpus Christi, alleging- that on .January 3, 1016, defendant in error Agnes Boedker and husband, H. H. Boedker, owned certain community property, described in said petition; that said H. H.
