TENNEY, District Judge.

Plaintiff Index Fund, Inc. (“Index Fund”) brought this securities action over 14 years ago against numerous defendants alleging it was the victim of market manipulation which resulted in significant losses. After many years of on and off again activity of the parties, the sole remaining defendant Robert R.
