By deed of lease dated December 5, 1904, defendants, Overholt and wife, as recited'therein, “in consideration of the payment of the rents or royalties hereinafter provided, and the performance by the Lessee of all the terms, conditions and covenants of this lease by it to be performed”, thereby demised and leased unto the plaintiff, National Coal Company, its successors and assigns “all the land, coal, coal mines, mining rights and privileges which were conveyed to the lessors” by deed from John G-. Rogers and wife to said Overholt and wife, dated September 25, 1900, together…
