This matter is before the Court on Defendant Greyhound Lines Inc.’s Motion to Dismiss Plaintiffs Complaint, ECF No. 11. For the reasons discussed below the motion will be granted in part and denied in part. 1
I. BACKGROUND
Greyhound Lines, Inc. (“Greyhound”) employed plaintiff as a bus driver. See Compl. at 1; Def. Greyhound Lines, Inc.’s Mem. of P. & A., ECF No. 11-1 (“Def.’s Mem”) at 2.
