WILSON, Circuit Judge.
This is an appeal from a judgment of the District Court of Massachusetts in an action of tort brought by the plaintiff as administratrix to recover damages for the death of her intestate, which occurred when a flat car on which he was riding was derailed while being hauled over the tracks of the defendant’s railroad. Springfield in Massachusetts, and in Bellows Falls, Vt.
