KELLY, District Judge.
Plaintiff brought suit against the United States of America under the Federal Tort Claims Act, 28 U.S.C.A. §§ 1346, 2671 et seq., for damages suffered to his vessel while navigating in the Wrangell Narrows south of Petersburg, Alaska, as a result of an alleged collision with a navigation aid maintained by the United States Coast Guard. During the course of the trial evidence was introduced showing that the navigation aid, of great dimensions in size and weight, submerged and disappeared beneath the surface of the channel waters leading into Petersburg.
