Judgment of conviction of theft including a sentence of one to three years in the penitentiary was affirmed by this court upon defendant’s direct appeal in People v. Placek, 25 Ill. App. 3d 945 (1975). He subsequently petitioned for relief pursuant to the Post-Conviction Hearing Act (Ill. Rev. Stat. 1973, ch. 38, par. 122 — 1 et seq.) and section 72 of the Civil Practice Act (Ill. Rev. Stat. 1973, ch. 110, par. 72) alleging that the sentence and the sentencing procedures violated constitutional standards.
