CONNELL, Chief Judge.
On October 8th, 1965, at approximately 3:30 P.M., a party of Internal Revenue Service agents advanced upon an apartment building at 3058 Livingston Road, Cleveland, Ohio. Their immediate duty was to execute a search warrant directed to those premises, which had been issued upon the affidavits of Special Agents Nehrer, Kowalski and Mehrling, and which indicated that these premises had housed illegal gambling activities for some time.
