To the Honorable Justices of the Supreme Judicial Court:

Whereas, it appears to the Senate of the Ninety-Fifth Legislature that the questions of law hereinafter pro*240pounded are important and that it is upon a solemn occasion, the following statement of facts and questions of law are herewith submitted:
