GANEY, District Judge.

This matter comes before the Court on a petition to modify a decree of discharge in bankruptcy.

The petitioner, Vernon L. Parker, alleges that he is the holder of a certain negotiable promissory note in the principal sum of Three Hundred Ninety-Seven Dollars ($397) dated July 27, 1931, payable thirty days after date to the order of V. L. Parker at the Merchants and Farmers Bank of Portsmouth, Virginia, made and signed by John P. Early; that John P.
