Simons v. Tobin

This is an appeal from an order sustaining demurrers to an amended .bill of complaint and dismissing the bill in a suit for specific performance of a contract between complainant and defendants to convey certain de scribed real estate in the City of Miami. The only assignment of’error is the order from which the appeal is taken.

The contract sought to be enforced is contained, according to the allegations of the bill, in correspondence between the parties, consisting of letters and telegrams containing an offer to sell by defendants and agreement to purchase by complainant the land described.
