Respondent filed, on July 27, 1959, a petition for admission to probate of the last will of Val M. Fiedler, deceased. Respondent was named executor in the will. On July 29, 1959, appellant filed “Objection to appointment of Executor and Cross-Petition for Letters of Administration”.
