This is an action of replevin brought by defendant in error to recover the possession of the two-story frame store building situate on the middle third of lot 8, in block 118, in the city of Omaha. It appears from the bill of exceptions that the plaintiff rented the premises for one year from the first day of June, 1877, the rent to be paid at the end of each month. The plaintiff claims that he rented the premises the second time for one year from the first day of June, 1878, the rent to be paid monthly in advance.
