The question over which the most serious contention exists in this case is whether the railroad company has the power, under its charter, to maintain and operate, or cause to be operated, the elevators in question as public warehouses of class “A.” If the prayer for a perpetual injunction is granted, the duty of the railroad company to maintain these elevators as public warehouses would thereby be legally established.
