(dissenting) : This matter is before this Court upon the return by the respondents to a writ of certiorari issued to the said board by Mr. Chief Justice Stabler of this Court.
The purpose of the writ was to have.the Board of State Canvassers send to this Court all the papers pertaining to an election in Charleston County, November 7, 1938, in which the petitioner claims to have been elected tO' the office of Clerk of Court of Common Pleas and General Sessions for the named county, upon his petition and showing that the State Board of Canvassers refused to canvass the returns, count the ballots…
