For a proper understanding of the issues involved in this appeal, a brief statement of the facts is necessary. At the general election in 1928, J. Hart Coker was elected Clerk of Court for Darlington County. He died during the year 1930, and Miss Blanche C. Law was appointed by the Governor to hold until the next election. J. E. Cannon, the appellant in this action, was nominated for the position in the Democratic primary of 1930' and was elected at the general election of that year.
