The instant case is presented for appellate review for the second time. Previously, plaintiff purported to appeal from a minute order dismissing her complaint, no judgment having been made or entered. The sole question before the court was whether such an order was appealable. Holding that it was not, the court ordered the appeal dismissed as premature, and reinvested the trial court with jurisdiction to reopen the case for further proceedings. (Sproul v.
