Affirming.

Appellee Miles was nominated and elected sheriff of Trimble county in 1921, for a term .of four (4) years. While he was a candidate he entered into an arrangement, with appellant Mullikin by which the latter, in consideration of aiding appellee Miles in the election, was to become office deputy in case Miles was elected sheriff, so it is averred in the petition. After the election and induction of Miles into office he appointed appellant Mullikin as office deputy, who accepted the place and entered upon the performance of the duties and…
