This is an action for damages under the Federal Employers’ Liability Act (45 USGA §§ 51-59) for the death of a switch engine foreman, of appellant, killed in the yard at Mobile.

Objection is made to the complaint that it fails to show that decedent was not a trespasser, or was not at a place where defendant did not owe him the duty of ordinary care not to cause his death, and that the complaint does not show a breach of duty.
