— Appeal by the People from an order of the Supreme Court, Westchester County (Martin, J.), entered October 25, 1983, which granted defendant’s motion to dismiss the indictment on the ground that he had been denied his statutory right to a speedy trial pursuant to CPL 30.30. 11 Order reversed, on the law, motion denied, indictment reinstated, and matter remitted to the Supreme Court, Westchester County, for further proceedings. 11 On February 3, 1981 a felony complaint charging defendant with robbery in the first degree was filed in the City Court of Mount Vernon.
