SENTELLE,1 Circuit Judge:

A general court-martial composed of members convicted First Lieutenant Timothy J. Rushatz of larceny of $1,500.00 from the United States and of three specifications of conduct unbecoming an officer by providing false receipts to other officers to submit for per diem claims, in violation of Articles 121 and 133, Uniform Code of Military Justice, 10 USC §§ 921 and 933, respectively. Thereupon, the members sentenced Lieutenant Rushatz to dismissal, to*452tal forfeitures, and a fine of $10,000.00. The convening authority eliminated the fine but otherwise…
