The defendant was indicted for assault with intent to kill and murder. At trial, he was found guilty of the lesser included offense of aggravated assault. All questions of law raised by exceptions were reserved and transferred by Keller, C.J.

On the night of October 6, 1973, and in the early morning hours of October 7, 1973, the defendant had been a patron at a local drinking establishment in Penacook called The Buggy Barn.
