B. G. Towles, who bad purchased a tract of land from Jesse 'Campbell, and was in the peaceable possession thereof under a conveyance containing a covenant of general warranty, sued Campbell for a rescission on the ground that the title was defective. A demurrer having been sustained to the petition, Towles filed an amended petition to which a demurrer was also sustained with leave to amend.
