I. INTRODUCTION
Plaintiff Mount Vernon Fire Insurance Company (“Plaintiff’ or “Mount Vernon”) seeks summary judgment on its action for an order declaring that it does not have a duty to defend or indemnify insured defendants, Abesol Realty, Estate of Bencion Neiss 1 , and Neiss Management (“insured defendants”), in an underlying action for personal injuries suffered by defendant Anthony Thompson, an infant, as a result of his exposure to and ingestion of lead paint in an apartment owned and managed by the defendants. 2 Jurisdiction is proper in this…
