OPINION

SWEET, District Judge.

Plaintiff Homer Aki Mathis (“Mathis”), a prisoner in the custody of the Clinton Correctional Facility, brings this action pro se pursuant to 42 U.S.C. § 1983 seeking redress for an alleged violation of his constitutional right to perfect an appeal from his criminal conviction in the New York State Courts.
