Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court, entered in Albany County) to review a determination of *1058respondent Commissioner of Health which found petitioner guilty of patient neglect.

Petitioner is a licensed practical nurse and was employed as such from August 1986 to August 1987 by the Daughters of Sarah Nursing Home in Albany County.
