*413MEMORANDUM OPINION AND ORDER
ARRAJ, Chief Judge.
This is an action brought pursuant to 42 U.S.C. § 2000e et seq., Title VII of the 1964 Civil Rights Act. The plaintiff was discharged by the defendant Gates Rubber Company (Gates), and filed a charge with the EEOC alleging racial discrimination as the reason for the discharge. The plaintiff was notified on December 10, 1970, that voluntary compliance had not been achieved by the EEOC and that he was entitled to bring this suit.
