On October 19, 1982, appellant Horne filed suit against “Johnson Carswell d/b/a Kar Korner” to recover damages for alleged violations of the federal Consumer Credit Protection Act and the Georgia Motor Vehicle Sales Finance Act arising from her purchase of a motor vehicle from Carswell. On October 26,1982, Carswell filed his answer, denying liability; and on December 10, 1982, he filed a motion for summary judgment, asserting for the first time that the sale was in fact made by a corporation known as Kar Korner, Inc., rather than by him personally.
