Plaintiff sued the defendant for a partition of North half of Northwest quarter and West half of Northeast quarter, Sec*329tion 13, Township 3 South, Range 4 West, alleging that he and defendant were co-owners in division and in the portion of one-half interest each and that the property-should he partitioned in kind. Defendant answered the suit, denying plaintiff’s ownership in the land and affirmatively alleged that it owned the whole of the property.
