MEMORANDUM OPINION
EMMET G. SULLIVAN, District Judge.
This is an action for copyright infringement arising under the United States Copyright Act, 17 U.S.C. § 101. Plaintiffs allege that defendants infringed their copyrights by giving unauthorized public performances of six musical compositions at defendants’ establishment, Zanzibar on the Waterfront Restaurant. Pending before the Court is Plaintiffs’ Motion for Summary Judgment.
