James E. Holland, David C. Holland, and Texas Rice Land Partners, Ltd. (“Texas Rice”) own a Texas cattle ranch and rice farm. Mike Latta, a rice farmer, leases the property. Denbury Green Pipeline-Texas, LLC (“Denbury Green”) sought to construct a carbon dioxide pipeline across the property. When Texas Rice refused to allow Denbury Green to survey the property, Denbury Green obtained a temporary injunction against Texas Rice.
