Constance Szymczyk died on August 31, 1965. During the last 5 years of her life, she had maintained a business relationship with the defendant, Carl Wagner, a real estate broker, who, pursuant to an agreement between them, acted as her agent by investing her capital in the purchase of various parcels of real estate, construction of residences upon them, and seUing of the properties.
