This suit is brought by the beneficiary of a life insurance policy to recover for the death of the insured.

On August 11,1962, (premium receipt dated August 19, 1962), Willie Ruth Carmichael took out a mortgage term life insurance policy in the amount of $4,000.00 upon the life of her husband, Willie Clyde Carmichael. She paid Arthur Port, an agent of the defendant insurance company, a premium of $2.23 for which she was given a receipt.
