This is a divorce suit in which defendant appeals from a decree entered November 19, 1948. Since the entry of the decree, defendant,Hugo Herman Listl, las died and by order of tie Supreme Court on December 13,1950, tie cause was revived in tie name of Paul F. Listl, administrator of tie estate of Hugo Herman Listl, deceased. In view of tie fact tlat property-rights are involved, the divorce action survives the death of one of the parties litigant. See Workman v. Peterson, 327 Mich 456. For convenience we herein refer to Hugo Herman Listl as defendant or appellant.
