CRANDALL, Judge.

The Director of Revenue (Director) appeals from the circuit court judgment reinstating Patrick McDonough’s driving privileges. We affirm.

On December 21, 1996, a Missouri State Highway Patrol trooper arrested McDon-ough for driving while intoxicated. McDon-ough consented to a breath test. The test showed a blood alcohol content of .247.
